Empty Dwelling Management Orders

Like many of us I have been watching Chanel 4’s series “The Great British Property Scandal” which is highlighting our need for more affordable housing. The program has been bombarding us with figures such as there are 1 million empty homes in the UK and 2 million families in the UK are in a need of a home, as well as highlighting government and local council mistakes of carrying out large scale compulsory order schemes that have destroyed communities and increased the UK housing problem.
 
Although compulsory order schemes have added to the problem, a large percentage of houses left empty are privately owned, in November 2010 Shelter Cymru called for councils to bring 26,000 empty privately-owned homes in Wales back into use. So what can be done to turn these properties into affordable family homes? The answer may be Empty Dwelling Management Orders (EDMOs).
 
What is an EDMO?
Wikipedia says an Empty Dwelling Management Order( EDMO’s) are a legal device used in England and Wales, which enable local authority to put an unoccupied property back into use as housing. EDMOs were created by the Housing Act 2004, with the relevant legislation coming into effect in mid-2006.
EDMO’s sound like a great solution for local authorities to take control of houses left empty and turn them around to create affordable social housing, but what I can’t believe that since they were introduced in 2006 only 50 EDMO’s have been instructed in the UK and only 3 have been granted in Wales.
However I have read today, which prompted me to create this post that Carmarthenshire council in Wales has used a Final Empty Dwelling Management Order (FEDMO) to gain temporary control of a property. 
Empty Dwelling Management Order (EDMO) legislation allows councils to take over the management of empty residential properties with a view to agreeing with owners a plan to bring them back into occupation and a FEDMO is the final stage in the process which enables local authorities to take over management of an empty property for up to seven years enabling the property to be returned to a rentable standard

It seems that 2011-12 academic year has just started, but now is the time to market your property for the 2012-13 academic year so as an experienced Cardiff lettings agent we wanted to share some of our experience and put together a helpful guide for landlords and property investors looking to the buoyant Cardiff student rental market and maximising your cash flow with House of Multiple Occupation (HMO) .
 
1.       Location, location, location
As with any property investment location is key. Cardiff boasts several academic institutions so finding a an existing House of Multiple Occupation (HMO) or a property for convertion close to one of the following shouldn’t be too hard:

2.       Bathing & Sanitary
 
Make your HMO property more appealing to prospective student tenants by offering separate WC and if you can more than one shower/bathroom.
 
3.       Students are Social
 
Student property can be an excellent investment and can generate fantastic yields, but try to include a communal area. Some of our best performing student properties offer an open plan kitchen/living room where the student tenants can all relax together and watch a dvd on their flat screen tv.
 
4.       Broadband
 
Slow broadband equals unhappy tenants. Today’s students are forever tweeting or liking something or downloading music from iTunes, so broadband bandwidth and speed is VERY important to today’s student tenants. 
 
If you are providing broadband as part of the rental package make sure you have enough bandwidth for the number of tenants renting otherwise prepare for the constant moans and groans about broadband.

Tenant Reference using Google

Landlords, you have done everything right so far you advertised your property, arranged viewings, checked the tenants credit history and taken previous landlord and employment references or you have paid a letting agent to do everything for you.
Now you can provide yourself with peace of mind by logging onto Google and you favourite social media sites to cross reference your new potential tenant. Earlier this year Facebook hit 30 million UK users and is now averaging 1 million new users a month, Twitter as roughly 15 million registered users in the UK and LinkedIn has 5 million UK users with over half a million of us using the site each day and let’s not forget Google+ which is growing from strength to strength had had acquired over 20 Million global users in a matter of weeks.
The Social Media explosion has made it easier than even to make sure everything you have been told by your potential tenant rings true. 
But what can be done to really delve into the world of your potential tenant? The answer is Social Media and search engines such as Google, by spending a few moments online armed with a search engine of choice and information such as a tenant’s name, location and employer details you can begin to really see if you are dealing with the” perfect tenant” or the “tenant from hell”.
So here are a few steps to online tenant stalking, I mean referencing using Google:
 
STEP 1: Simple Google Search
Open up Google and search for your tenants name and location as follows
“john smith” AND london
You can see in the example that the tenants name is surrounded by quotation marks, this is because search engines such as Google will return results of all the words in your search i.e. results containing John and Smith whereas if we use quotation marks we are telling Google to search for a specific term in this case the name “john smith”. 
You can see the word “AND” in capital letters this is because search engines such as Google use Boolean logic when conducting a search, the AND operator must be written in capital letters as we are effectively commanding Google to search for the tenant “john smith” with any connection to the location London.
Obviously this is a very loose search and will return many results, but this is a very good place to start and this type of search will return any news relating to your tenant in a specified location and a good place to begin to narrow down your search.
 
 Step 2: Employment Check
You can also check the tenant’s employment references stack up, by once again carrying out a simple search on Google:
“john smith” AND “company name”
Most companies now have pages listed on LinkedIn and many professionals across the UK have created a LinkedIn profile, so chances are a simple search will bring back some results also this simple search will bring back company director’s results and company news. 
Alternatively, you can search the tenant’s company name and job titles such as HR Manager so ensure the company contact provided by the tenant is actually the person they say they are and not the tenants mate.
A good example would be:
“hr manager” AND “abc accountants”
OR
“human resources manager” AND “abc accountants”

Word of Mouth a Powerful Channel for Cardiff Lettings Agent

We have a very good relationships with many of the tenants of the Cardiff property we manage in particular a great bunch of guys who are Cardiff students  living in a House of Multiple Occupation (HMO) just off Whitchurch Road.
While visiting them this week two of the tenants  mentioned they have friends looking for property in the area, three separate groups looking for a 3 bedroom property, 4 bedroom property and a group looking for a 5 bedroom property ideally in located along Whitchurch Road, or one of the side streets such as “The Colonies”.
Then it dawned on me when I left this particular property on Australia Road, I looked up and down the street and saw a variety of Cardiff lettings agent boards, in particular one property directly across the road which is being advertised by two Cardiff property agents and has been available for rent since June this year.   But why haven’t they been let when I have just been told of three separate groups looking for similar?

Rent in Cardiff or Buy?

The Nationwide House Price Index for October 2011 recorded the average Cardiff house price at £204,599 and according to Cardiff Council research the average Cardiff household income equates to £31,829 per annum. The cost of the average Cardiff house is now 6.4 times the average Cardiff household income.
So is a citizen of the Welsh capital better to rent in Cardiff or Buy a property in the principality?
Let’s look at the figures, to purchase the average Cardiff house with a 80% Loan to Value (LTV) mortgage a buyer would need a 20% deposit which equates to £28,563.40 and will then have to pay the taxman 1% of the cost of the property as a “Stamp Duty” which is a further £2,045.99 (Although first time buyers are exempt up to £250,000 threshold applies from 25 March 2010 up to 24 March 2012 inclusive) and then added to the equation is the lenders arrangement fees from £499 to £1995.
So to purchase an average house in Cardiff a figure ranging between £31,108.30 to £32,604.39 is needed before any legal fees, surveyors fees and removal costs are taken into consideration take the figure up to a ball park £35,000, no wonder the average age of a first time buyer in the UK is now 43, what hope have you got it you have left university with a large loan for tuition fees?
So now you have your thirty something thousand pounds saved and armed with your 80 per cent Loan to Value fixed rate mortgage you can expect to pay rate circa 3.5% if you have a squeaky clean financial track record which equates to a monthly repayment of about £587
 
As a Cardiff lettings agent we are still seeing a trend of rising rent prices even though we are entering the so called “quiet period”, but what can you expect to pay per calendar month?

Landlord don’t get fined for breaching Gas Safety Regulations because you could end up with a hefty fine for failing to fulfil your responsibilities as a landlord.
A fine of £3,000 has been imposed and a landlord ordered to over £2,000 in costs for breaching Gas Safety regulations and failing to fulfil their responsibilities to their tenant
A Huddersfield landlord their tenant at risk by ignoring repeated warnings to have the gas appliances in the property safety-checked, the Huddersfield landlord ignored several requests by the local council and the Health and Safety Executive (HSE) between May 2010 and March 2011 when requested to provide a Gas Safety certificate and also failed to respond when served with an Improvement Notice.
 
Dr Angus Robbins an HSE Inspector who investigated this specific case said “In addition to the risks of fires and explosions from faulty gas appliances, many people are made ill, and some 20 people die from carbon monoxide poisoning every year owing to poorly-maintained gas appliances.

Dr Angus Robbins went onto say
Landlord duties are very clear – they must ensure gas appliances are checked for safety by a Gas Safe registered engineer and provide their tenant with a copy showing that the appliances and flues were operating safely at that time. HSE will not hesitate to bring Landlord before the courts when they are prepared to risk their tenants’ safety for financial gain.”

Paul Johnston, chief executive of Gas Safe Register, said:

“It is important for
landlord to meet their responsibilities and for tenants to know their rights when it comes to gas safety. If there are gas appliances in a property they need to be maintained properly by a suitably qualified Gas Safe registered engineer and have an annual safety check. An up-to-date Gas Safety Record should always be available and tenant  should ask to see if it they do not have a copy.”

In today’s rental market we are seeing rental prices increase month on month, so how much longer can this trend continue before the price to rent an average Cardiff property is no longer sustainable by the average Cardiff household income?

Research has shown that 1.8m people in Wales are at risk of carbon monoxide poisoning because they do not have an alarm. What is staggering about this data is that research shows 74% of people are unaware that carbon monoxide - which has no colour, taste or smell - can kill, and only 15% realise it can cause brain damage.
The Carbon Monoxide - Be Alarmed group say only 38% of Welsh homes and Cardiff property own a carbon monoxide alarm and  are lobbying the Welsh government to amend building regulations to ensure carbon monoxide alarms are installed in new homes. Members of the group will meet assembly ministers at the Senedd at an event hosted by Islwyn AM Gwyn Price.
Campaign spokeswoman, Christine McGourty, said: "There are two simple steps we'd like the Welsh Government to take.
"Firstly, building regulations should be amended so that new homes come with alarms already installed.
"Secondly, providing an alarm should be part of a landlord's annual gas safety inspection."

The key findings of these statistics are:
·         Eighty-nine per cent of landlords were private individual landlords responsible for 71 per cent of all private rented dwellings, with a further 5 per cent of landlords being company landlords responsible for 15 per cent of dwellings.
·         More than three quarters (78 per cent) of all landlords only owned a single dwelling for rent, with only 8 per cent of landlords stating they were full time landlords.
·         The majority (54 per cent) of dwellings met the Decent Homes Standard though this rose to nearly three-quarters (74 per cent) for those let by new landlords. Over two-fifths (42 per cent) of all dwellings have had an Energy Performance Certificate.
·         Fifty-one per cent of all dwellings were acquired since 2000, 25 per cent in the ten years between 1990 and 1999.
·         In terms of formal letting and management practices, nearly all landlords and agents (97 per cent) made use of a written tenancy agreement, with 91 per cent requiring a deposit, and 84% requiring tenants to provide a reference.
·         Almost half (47 per cent) of all landlords were happy to rent to tenants on Housing Benefit (HB) or the Local Housing Allowance (LHA), with a further 21 per cent saying they would be encouraged to do so if payments were not made direct to the tenant.
·         In terms of issues considered a serious problem, 18 per cent of landlords or agents stated issues related to HB or the LHA, and 10 per cent the level of HB in the area. Issues not considered a problem by landlords were low demand (82 per cent), mortgage payments (76 per cent) and finding reliable builders (73 per cent).
·         A third (33 per cent) of landlords and agents, who had heard of the Housing Health and Safety Rating System reported that 58 per cent of the dwellings they were collectively responsible for had received some form of assessment for potential hazards.

Student Landlords: Applications for Welsh Universities Down 12.3 per cent

It has been well documented in the press that the potential tripling of course fees to £9000 per year at some universities has resulted in a 9% drop in University applications for 2012. So how what are the figures for Welsh University towns?
WebLetz a Cardiff Letting Agent has been reviewing the data posted on the UCAS website and Welsh universities have seen a 12.3 per cent fall on applications from last year compared to English Universities seeing a 9.1 per cent fall, Scottish universities a slight fall in applications of 1.1 per cent and universities in Northern Ireland seeing a minimal increase in applications of 0.1 per cent on 2011. On the plus side Welsh universities have seen an 11.8 per cent increase in applications from Non EU applicants.

Today, Friday 28th October 2011 has seen the release of the Land Registry House Price Index which has seen Welsh house prices drop a hefty 5.8 per cent from this time last years and a monthly change of down 1.7 per cent resulting in an average house price of £117,813 across Wales. The overall situation across England and wales as a whole is less dramatic with England and Wales combined seeing an annual fall of 2.6 per cent and a monthly fall of 0.3% with today’s average house price being £162,109.
How have Welsh house prices faired compared to the other regions across England? The only region to experience a positive annual price change is London with a movement of 2.7 per cent. The region with the largest annual price fall is the North East with a movement of-8.2 per cent. The North West saw the greatest monthly price rise with a movement of 1.0 per cent. The North East is the region with the most significant monthly price fall with a movement of -3.9 per cent.
Most Welsh regions have seen a fall in house prices with Bridgend seeing the largest annual fall of 9.6 per cent and Cardiff seeing a 2.9 per cent fall from this time last year with the average house price in the Welsh capital being £142,817. The only Welsh region to have bucked the trend is Merthyr Tydfil which saw a 1.9 per cent annual gain with the average house price now £73, 468.

Landlords Warned over New HMO Rental Rules

Landlords who rent out homes to students or large groups of other people have been warned not to get caught out by new House of Multiple Occupancy( HMO) rules.

The Association of Residential Letting Agents (ARLA) has said that many local authorities have indicated their intention to change the rules surrounding homes inhabited by groups of unrelated people, known as Homes in Multiple Occupation (HMO).

Until last year, landlords only had to apply for an HMO licence if the property had six or more unrelated tenants with shared amenities such as a bathroom or kitchen over three levels.

However, the rules – known as Article 4 – now cover any home with three to six tenants who share common facilities.
